3. User-Generated Content
When you submit reviews, photos, place listings or any other content to Marketchatja, you agree that:
- You own or have the right to share the content you submit
- Your content is truthful, accurate and based on genuine personal experiences
- You grant Marketchatja a non-exclusive, royalty-free licence to display and use your content on the platform
- Your content does not infringe on the intellectual property or privacy rights of any third party
All submitted content is subject to review and moderation. We reserve the right to remove any content that violates these terms without notice.
4. Prohibited Conduct
You agree not to use Marketchatja to:
- Submit false, misleading or fraudulent reviews or listings
- Post content that is offensive, defamatory, discriminatory or harassing toward any individual or group
- Spam, advertise or promote products or services without our authorisation
- Attempt to manipulate ratings or reviews for any place or business
- Use automated tools, bots or scripts to scrape or interact with the platform
- Impersonate another person or entity
- Violate any applicable Jamaican or international laws or regulations
Violation of these rules may result in immediate suspension or termination of your account.
5. Place Listings
Anyone may submit a place to the Marketchatja directory. All submissions are reviewed by our moderation team before appearing on the platform. By submitting a place you confirm that:
- The place is real and located in Jamaica
- The information provided — including name, address, contact details and category — is accurate to the best of your knowledge
- You are not submitting the place for commercial gain, self-promotion or to disadvantage competitors
- You have no undisclosed conflict of interest with the place being listed
We reserve the right to reject, edit or remove any listing at our sole discretion.
6. Reviews and Ratings
Reviews on Marketchatja must reflect genuine, first-hand experiences. You agree not to:
- Write reviews for places you have not personally visited
- Write reviews in exchange for payment, discounts or other incentives
- Submit multiple reviews for the same place from the same or different accounts
- Write reviews about your own business or a competitor’s business
We reserve the right to remove reviews that we reasonably believe violate these guidelines.
7. Privacy
Your use of Marketchatja is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Please review it to understand how we collect, use and protect your personal information in accordance with the Jamaica Data Protection Act (2020).
8. Intellectual Property
The Marketchatja name, logo, design and all original content on the platform are the property of Marketchatja and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify or create derivative works from our content without our express written permission.
User-submitted content remains the property of the original creator. By submitting content you grant us a licence to use it on the platform but you retain ownership.
9. Disclaimer of Warranties
Marketchatja is provided “as is” without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness or reliability of any listings, reviews or other user-generated content on the platform. Use of the platform is entirely at your own risk.
We are not responsible for the quality, safety, legality or availability of any places listed on the platform, or for any transactions or interactions between users and listed businesses.
10. Limitation of Liability
To the fullest extent permitted by law, Marketchatja and its owners, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from your use of the platform shall not exceed the amount you have paid to us in the twelve months preceding the claim, if any.
11. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date shown at the top of this page. We may also notify registered users by email for significant changes.
Your continued use of the platform after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
